Terms of Use
These terms govern your use of the AssetAssure website and set out how a free trial of the AssetAssure service becomes a paid subscription. Use of the service itself is otherwise governed by the customer agreement between us and each customer.
1. About these terms
The website at assetassure.io (the "website") is operated by Pagey Corp (ABN 702787648), referred to as "Pagey Corp", "we", "us" and "our". By using the website you agree to these terms. If you do not agree, please do not use the website.
AssetAssure (the "service") is a hosted product created and provided by Pagey Corp that our customers install on their payment pages to inventory, justify and monitor the scripts those pages load. Access to the service is provided under a written customer agreement. Where these terms and a customer agreement conflict, the customer agreement prevails for the service.
2. Information on the website
The website describes the service, how it works and how its outputs relate to requirements 6.4.3, 11.6.1 and 12.5.1 of the Payment Card Industry Data Security Standard (PCI DSS) version 4.0.1. We try to keep this description accurate and current, but features, screens and figures may change without notice, and the service you receive is defined by your customer agreement rather than by the website.
Not compliance advice
References to PCI DSS are descriptive. We are not a Qualified Security Assessor and nothing on the website is legal, compliance or security advice. Whether a requirement is met for your environment is determined by you, your acquirer and your assessor, based on how you configure and operate the service alongside your other controls. Figures describing how much of the recurring work the service automates are estimates derived from the standard's testing procedures and depend on your configuration.
3. Enquiries
Submitting an enquiry is a request for information. It does not create a contract, reserve capacity or oblige either of us to proceed. You agree to provide accurate contact details and to submit enquiries only on behalf of an organisation you are authorised to represent. We handle enquiry information as described in our Privacy Policy.
4. Acceptable use
You may use the website to learn about the service and to contact us. You must not:
- probe, scan or test the vulnerability of the website or the systems behind it, or attempt to bypass any security or rate-limiting measure;
- submit enquiries by automated means, submit false or misleading information, or impersonate another person or organisation;
- copy, scrape or republish substantial parts of the website, or use its content to train a machine-learning model, without our written permission;
- interfere with the operation of the website or place an unreasonable load on it.
If you believe you have found a security weakness in the website or the service, please tell us at contact@pageycorp.com before disclosing it publicly. We will acknowledge good-faith reports and will not take action against researchers who follow this process, avoid accessing or altering data that is not theirs and give us a reasonable time to respond.
5. Intellectual property
The website, its text, graphics, design and code, and the AssetAssure and Pagey Corp names and logos are owned by us or our licensors and are protected by copyright and trade mark law. You may view and print pages for your own evaluation of the service. Any other use requires our written permission. The collector script and any other software we publish are made available under the licence that accompanies them, which governs their use.
6. Third-party content and links
The website may reference third-party products, standards bodies and websites, including the PCI Security Standards Council. We do not control them, are not responsible for their content or availability, and do not endorse them unless we say so expressly. Trade marks of third parties belong to their owners.
7. Disclaimer
The website is provided "as is" and "as available". To the extent permitted by law, we make no warranty that it will be uninterrupted, error-free or free of harmful components, or that its content is complete or suitable for your purposes.
8. Liability
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law or any other law that cannot lawfully be excluded. Subject to that, and to the extent permitted by law, we exclude all liability for any indirect or consequential loss, loss of profit, revenue, data or goodwill, and our total liability arising out of or in connection with the website is limited to AUD 100. Liability for the service is governed by the applicable customer agreement.
9. Privacy
Our Privacy Policy explains what personal information we collect on the website and in the service and how we handle it. It forms part of these terms.
10. Free trials and subscription acceptance
We may offer an organisation a free trial of the service for a period we state when the trial starts. During the trial nothing is invoiced. Some features are withheld until a subscription starts, including downloading inventories and connecting webhook or Slack notifications; we say which in the service. When the trial period ends without a subscription having started, monitoring is paused until one does; the data collected during the trial remains available in the account.
A trial becomes a paid subscription only when an owner or administrator of the account starts the subscription in the service (Billing > Details), or when we do so on the organisation's behalf under a written agreement. When starting the subscription you choose how you are billed:
- Monthly: the subscription amount is invoiced on the first day of each month, starting with the month in which the subscription starts, which is invoiced in full.
- Yearly: twelve months of subscription at the discounted yearly amount, starting with the month in which the subscription starts, are invoiced immediately. A yearly subscription is not refundable once invoiced. Usage above the included allowances is still invoiced monthly.
Amounts are shown in the service exclusive of GST, which is added to invoices where it applies. Invoices are payable within the number of days shown on the invoice. The amounts, allowances and overage prices of the subscription are those shown in the service when you start it; we tell you before changing them.
11. Changes
We may change these terms from time to time by publishing the updated version on the website with a new date at the top. Changes apply from the date of publication. If you continue to use the website after a change, you accept the updated terms.
12. Governing law
These terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and the courts entitled to hear appeals from them.
